General Terms and Conditions

These General Terms and Conditions apply to all courses organised by us and events offered by us.

1. Course registration and booking confirmation 

Course registrations can only be accepted in writing. Either by registering via our website www.zist.de under course registration or by post. If you do not have access to the Internet, we will be happy to send you a registration form on request.

It is recommended to register as early as possible as the number of participants on most courses are limited; places are allocated in the order in which registrations are received.

As soon as we have received your registration via our website, you will receive an automatic confirmation of receipt; once the registration has been booked you will receive a confirmation of registration.

If you register by post, a registration confirmation will be sent as soon as possible via e-mail or by post.

A registration confirmation is binding and obliges you to pay the course fee.

If the course you have chosen has reached the maximum number of participants, your registration can be placed on a waiting list and ZIST will inform you when a place becomes available.

With your registration you commit to attending the entire course.

We recommend that you book accommodation with us while participating in our courses, as it is an essential and integral part of the ZIST experience. What is learnt in theory and self-awareness in a ZIST course – whether for personal development or for professional training, further education and training – is put into practice in the group community.

Should accommodation not be required please confirm with our reception.

2. Payment

Course fee payments should be paid no later than four weeks before the start of the course or by the due date stated in your registration confirmation. In the case of last-minute registrations, course fee payments should be made on receipt of the registration confirmation.

With your payment less than 14 days before the start of the course and your attendance at the course, you declare your agreement that our services should begin during right to withdrawal which you are entitled to (see paragraph 6).

Please state on your payment transfer your name and course number.

3. Discounts

Members of the ZIST Förderverein e. V. (https://www.zist.de/de/zist/zist-foerderverein) receive a 10 % discount on self-awareness courses.

If, for financial reasons, you are unable to attend a self-awareness workshop a percentage of the course fee may be covered by the ZIST Förderverein e. V. If you are interested, please write to verein@zist.de. Your enquiry will of course be treated confidentially.

Should a discount on the course fee be approved this will be communicated to you and shown in the registration confirmation. For the part of the course fee to be paid by you the provisions of these General Terms and Conditions apply.

4. Arrival

Please be aware of our arrival times that were sent with your registration confirmation. If you arrive earlier, we cannot guarantee that your room will be ready for you to check in. We also ask you not to attend if you are suffering from an infectious disease.

5. Cancellation conditions

Should you wish to cancel your registration please do so in writing either via e-mail or post.

Regardless of the reason for cancellation, the following cancellation conditions apply:

By cancellation of a self-awareness workshop up to four weeks before the start of the course we charge a flat-rate administration fee of 50 euros.

By cancellation of a workshop from our range of further education and training courses up to four weeks before the start of the course, we charge a flat-rate administration fee of 80 Euros.

By cancellation of either a self-awareness course or a further education training later than four weeks before the start of the course and earlier than 24 hours before the start of the course, 50 % of the course fee and the cost of board and lodgings you have booked are due.

By cancellation of either a self-awareness course or a further education 24 hours before the start of the course, or a no-show or an early departure from the course, the course fee and the full cost of the board and lodgings you have booked are due.

You are not entitled to a refund of the course fee for those courses that have not be attended or partly attended.

5.1. Non ZIST courses

In the case where the course organiser is not ZIST gGmbH but the course takes place at ZIST the cancellation conditions as stated under point 5 apply only on the booked board and lodgings.

5.2 Travel insurance

We recommend that you take out travel insurance to protect yourself against financial losses if you are not able to honour your course booking. A travel insurance form is sent out along with your registration confirmation.

Should you possess a travel cancellation insurance, take note that this should also cover for seminar visits.

6. Information obligations and right of cancellation for distance contracts

Courses are booked with ZIST gemeinnützige GmbH exclusively using means of distance communication (e. g. letter, e-mail). We are obliged to inform you about various points and refer to our information sheet on the right of withdrawal for distance selling contracts. For your rights of withdrawal on your contractual declaration please refer to our right of withdrawal policy.

7. Cancellation or rescheduling by ZIST gGmbH

If the minimum number of registrations for an event has not been met or for other reasons for which ZIST gGmbH is not responsible for, i. e. illness of the lecturer or official directives (e. g. a pandemic) where a course cannot take place, ZIST gGmbH is not obliged to carry out the course.

Should ZIST gGmbH be forced to cancel a course, we will inform you immediately and refund any amounts already paid. If a course can be held online, ZIST gGmbH can offer the course online.

Should you not accept the online course our cancellation conditions apply. No further claims against ZIST gGmbH can be made. Any liability from registered participants for any losses, such as costs for purchased tickets, railcards or similar, is excluded.

In the event of the need to reschedule a course, we will inform you as early as possible and you have the option to cancel your registration. It is advisable to check two weeks before course begin if the course will take place.

8. Course changes

In exceptional cases, especially in the case of further education and training courses, it may be necessary to change dates and implement programme changes this will be communicated immediately.

9. Place of fulfilment

The place of fulfilment is 82377 Penzberg.

10. Copyrights and course content

The content design of courses and teaching materials for further education and training programmes is the responsibility of the instructors and lecturers.

Copyrights of teaching materials as well all copyrightable objects used by ZIST gGmbH in the context of the course and further education and training programmes shall remain the sole property of ZIST gGmbH and the instructors and lecturers. A right of copying and redistribution is not permitted.

11. Liability clause

For damages resulting from injury to life, limb and health as well as for the violation of essential contractual obligations (cardinal obligations) we are liable regardless of the degree of fault. Cardinal obligations are obligations that are necessary to fulfil the purpose of the contract, in this case the organisation and execution of the booked courses. Otherwise, we are only liable for wilful or grossly negligent breaches of duty. Liability for simple negligence is excluded. Insofar as we are liable, this shall only apply to the extent of typically foreseeable damage.

These restrictions also apply in favour of our legal representatives and vicarious agents if claims are asserted directly against them. We expressly point out that the courses we organise may/can involve both mental and physical stress. Each participant bears full responsibility for his or her own health constitution and their activities during the courses.

12. Applied law

These General Terms and Conditions and all contracts concluded on the basis of these General Terms and Conditions, are exclusively subject to German substantive law with the exclusion of the provisions of the CISG (UN Convention on Contracts for the International Sale of Goods).
